Exxon Mobil NH Pollution Case

Exxon Mobil must pay more than $230m in damages for polluting groundwater in NH.  They use a chemical in gasoline known as MTBE.  It is supposed to help reduce the smog produced by gas engines.

Do you believe this could be a catch 22?  If they wouldn’t have used MTBE, maybe they would be sued for product liability (as opposed to just the additive being the defective product).  However, with the additive being found as a pollutant in the groundwater they are liable for monetary damage to the state.
